Distribution Update:
On November 30, 2011, the United States District Court for the District of Massachusetts
ordered the distribution of the Net Settlement Fund. Consumer checks mailed on December
16, 2011 and TPP checks mailed on December 27, 2011.
There are two Class Action Settlements with AstraZeneca Pharmaceuticals LP (“AstraZeneca”)
related to two different classes of purchases of the drug Zoladex®. This drug is
used to treat prostate cancer, advanced breast cancer, endometriosis, and uterine
fibroids. This lawsuit is not about the safety of Zoladex®. The name of the
lawsuit is In re: Pharmaceutical Industry Average Wholesale Price Litigation,
Docket No. 01-CV-12257-PBS, MDL No. 1456 (D. Mass.).
Two class action Settlements with AstraZeneca Pharmaceuticals LP (“AstraZeneca”),
the maker of Zoladex®, have been reached. The lawsuit claims, but AstraZeneca denies,
that AstraZeneca reported false and inflated average wholesale prices (“AWPs”) for
Zoladex®. The reported AWPs are used to set drug prices that are paid by private
health insurers and consumers paying cash or making percentage cop-payments under
private health insurance plans.
AstraZeneca agreed to pay $90 million in the Nationwide Settlement and $13 million
in the Massachusetts Settlement. The Settlements are not an admission of wrongdoing
or an indication that any law was violated. AstraZeneca has entered into the Settlements
to avoid further expense, and to avoid the risks of uncertain litigation. AstraZeneca
denies any wrongdoing.

A percentage co-payment is a payment that varies according to the price of the drug
(i.e. 20% or 25% of the total cost). If you paid the same amount (i.e. $10, $20)
per prescription, regardless of the cost of the drug, you did not make a percentage
co-payment and are not included in the Settlement.
